H4 to H1 transfer

Hi All,

I am new to this forum and I have one question. Appreciate your response.

My wife is on H4 status and she came to US in Nov '06. I want to transfer her from H4 to H1 and I have planned to apply in April.

Now, we have plans to go to India in April and come back in May or June. So, at the time of filing my wife will not be in US. Will this be a problem? Is it required for her to stay in US or the I94 should be active at the time of filing?

I am on H4 visa right now and applying for H1B visa this April. I am planning to go to India in April end and come back in june will there be any problem as I am applying for my H1b and going to India?
