Need Help regading H4

Hi Subramanyam,

I am came to US on H1b this January(2007)

I want to get my wife on H4 and then need to apply H1b for her in this year quota.

If she enters on H4 after filing H1B soem time in may will she is able to enter to US

Once she gets H1B aaprovel, she can still stay in US on H4 or need to go back to Inida once she gets H1B status gets approvel.

whats is the status if her H1B gets rejected and plse let me know what I need to do now

---- Filing H1 in May will be too late and the present indictions adn projections are that the H1 quota will be full within 15-30 days starting April 2nd

Once she gets H1B aaprovel, she can still stay in US on H4 or need to go back to Inida once she gets H1B status gets approvel.

---- That depecnds if she gets a I-94 or not

whats is the status if her H1B gets rejected and plse let me know what I need to do now

---- There is nothing you can do other than reapplying and waiting for the result. In the meanswhile she continues on H4

Thanks much for your response.
Still I have one more question. I would appreciate if you can answer.

--> I applied H4 for my wife and got stamped. Now she filed H1B and sent
the required documents to INS before entering into US. After some time
got H1B approval. As my understanding now she will be on H1B status
(Change of status from H4 to H1B).
Please let me know whether she can still stay in US with H4 stamping
until going outside the USA.
If No,she can go to Mexico or Canada for stamping and if they
reject to give H1B stamping ,please let me know whether she can
reenter into USA with existing H4 stamping or not.
