    Its nice to hear that the consulate has asked your passport..advance congratulations for this..

    It will be great if u can post the specifics like
    1)date u took the first interview,
    2) 2nd appearance date
    3)when you got mail from Consualte asking for passport??
    4)whn you replied to them or dropped passport?
    5)Did they mention anything in mail that they wil reutrn all the docs to you?
    6)Wat action did you employer take to resolve this AAP?
    7)Was you employer contacted by USCIS ?

    Am sure i have posted too many queries ..but to be honest you have become a senior in getting a mail from consualte askin for ur passport..so it will be gr8 if u help us with the answers..

    Please tel us hw the employer dealt ths case..as ths is key here in AAP.

        221g given green colour form

        Hello guys,
        Helpme out . Recently i was given 221g green color form asked me to drop through VFS service.

        Do i need to submit the PASSPORT,156,157,129,797 and all?????????
        Or will they call me after verifying the required docs specified on 221g form?

        can anybody tell me the procedure ?
        and how long it will take to get visa?
        what are the chances of rejecting visa ?????
        Plzzzz post soon worried alot awaiting for u all inputs

          Hello Sateesh,

          You will have to follow the Instructions just as clearly mentioned on the Form… They would have definitely and very clearly mentioned the List of documents they would need for taking a decision on your case…

          DS 156 and DS 157 is absolutely of no harm to post coz you can easily generate another True copy incase required.

          But when it comes to PASSPORT – I 797 – I 129 and other specified documents, Plz go through the Green 221G form that was given to you, they would have definitely mentioned whether to post them with the other documents.

          Usually, when it comes to a 221G case, We need to submit:
          All Docs as per 221G + DS156 + DS 157 + I 797 + I 129

          The Above mentioned Documents are the basic documentation that is required for them to take a decision. So it very sensual idea to send all the Documents. You can definitely take this chance because the services provided by VFS are very reliable and prompt, Coz they are there to do only this JOB. Incase, let’s think if they don’t require your I129 and I797 then they would return them at NO extra cost.

          If your Visa is granted, then they would again ask for your Passport for the VISA stamping, Hence there is no harm is posting your Passport with all the other Documents.

          And Mr.Sateesh, You gave us the Least possible Information and looking out for answers like When, How and When…Well, only if you can provide us what is written on the form and what docs have they asked you to submit, only then we can analyze what category does your case fall under.

              Sorry for the late reply but i was stuck some where else.
              2) 2nd appearance date
              No 2nd appearance date.

              After one week
              4)whn you replied to them or dropped passport?
              Immediately after I got mail.

              No, for that only I have posted my question .

              My employer didnt reveal any thing regarding this.

                  Thanks for the info, this thread gave quite good informaiton.
                  I had a similar case in Dubai. I had appeared for an interview on 11th Jan 2007, was given a green form
                  with case number written on it.
                  What i could not get is that how much time did it took to get your case solved.

                    Every one

                    I run a consulting firm in USA. I have my employees coming up with all such queries and situations. When ever the VO says they have to send the I797 back to USCIS, it is for revockation of the approval or I797.

                    Reason is pretty simple. The client will not give a 1 yr itinerary for a Consultant who is in another country that too 6 months prior to the commencement of Project. At least we small time employers can not get some thing like this. On the other hand we would not have a in house project as most of us or rather all of us are into consulting. So we create some document with several loopholes and the VO knows as they look at it.

                    It is not your candidature they suspect, it is the Employer they are not satisfied with in these cases.

                    My advise is to talk to the employer before you file your H1. Ask them for all the documents that they will provide for 221(g). Look at them and show them to some one who has seen more of them. Only then you strike a deal.

                      221(g) white refusal

                      hello sridevi,

                      Same case happend to me, I had been to Chennai consualate on 1st Dec'06, after long waiting and verufying the docs, lady asked me -are u going to work for inhouse and given 221(g) blue form and asked me to submit the required petitioner tax returns, through drop box at hyderabad. same had been submitted through drop box on Jan 14th but again they asked me submit all empolyee list and desgnation of all empoyess and wage reports and I had submited the same docs from my consultant again on Feb 20th through VFS drop box at hyderabad. But again they sent me a 221(g) white on 16th March 07 sending back only passport and keeping all other documents with them stating that "your petitioner does not appear to be either or willing to provide the qualifying the employement in the US in accordance with appropriate laws and regulations and aslo informed that my case has been suspended and the I-129 petition for NIV filed will be sent to USCIS with memorandom explaining the facts presented at the time of interview. US consualte in chennai no longer handling my case and unable to give any information on the status of my petition and stated that my visa had been refused under section 221(g) of INA Act.

                      I'm totally confused and lost all my hopes of getting the visa now...Is there any way to contact USCIS to know the status? how long it will take to complete process at USCIS, is there any chances of getting the visa?...I'm frustated with whole process now...wants to forget it concentrate on my job at hyderabad.

                      It seems you also facing the same problem, suggest some advice.

                        The application your employer filed with USCIS was approved and they issued I797 to you. The consular officer is now not hoping that your employer has a job ready for you. So he took your I797 and sending it back to USCIS so that they can cancel the approval on your case.

                        In simple terms, bad luck.

                        How ever, USCIS will send a letter to your employer explaining why the VO at the consulate had requested for cancellation of I797. It would take any thing between 6 to 12 months for the letter to reach your employer. They will also send a form where in your employer can appeal the case in the Court of USCIS. It would take another 12 months for the approval. So, in next 2 yrs you may have a visa.

                          Is it for sure that you know once a case is sent to USCIS it takes ages to clear??

                          Also, i have seen some threads where ppl hav posted theier exp telling even after the case is gone back to usics they got reply in jus 1 month..how does this happen???

                          Can we just assume that the case is no more alive once it goes to uscis??

                          ur suggestions are welcome..

                            White form 221(g)

                            I had my visa interview on 21 Nov -was given 221g blue form specifying about 12 documents from the company -like tax papers, photographs ...etc the company sent me all the documents in feb and i submitted my documents on feb 16th through VFS on the 24th Feb i received a blue form with my passport saying the need further AAP time but on the 27th feb i received white form stating they are sending my Documents to USICS stating the same reasons you all have mentioned above

                            But I felt disheartened to read a mail saying that white form is a gone case, is it true please reply???
                            My company people had called me saying that not to worry as my documents have not reached USCIS till now, as they had inquired at the USCIS, and asked me not worry as they will do all that is needed from the company's side

                            " In accordance with United States law and Department of State guidelines action on your case has been suspended, and your petition for a Non-immigrant Worker filed on your behalf was returned to the United States Citizenship and Immigration Services (USCIS) with a memorandum explaining the facts of your case as presented to us at the time of interview. The U.S. Consulate in Chennai is no longer handling your case, and will be unable to give you any information on the status of your petition”


                            This is a Clear cut intimation that the case is not completely Shut for good, but are put to Verification with the USCIS, due to various possible reasons (This is the body which gives us the initial Approval - I 797).

                            NOW!!! What Happens in the USCIS (This information was Gathered Purely based on my Research, Info Gathered and also from few Attorneys with whom I personally spoke to – NOT to blindly go with it)

                             The Application is sent back to USCIS with a cover letter Explaining the First hand Impression / Out come which the VO has experienced with you. They would include the facts which they had drawn out from your personal Interview and the documents that you have submitted (with or without 221G).

                             Here at the USCIS they will again scrutinize all the documents including I129+LCA+DS156**57+ Documents submitted by you as per 221G ( If given ) mainly looking for the document where they had the doubt ( Most of the Cases its either the Project related or Federal Tax Returns ) . There are few figures on the Tax returns which they look for which gives them clear cut information regarding the salaries paid, employees on Bench and mainly – whether it is a Body Shopping negotiator or a Genuine Development Company.

                             If they have further doubts, they walk in into the company or Call or Fax your Employer asking for a clarification.

                             The COST for carrying out the whole process that we are talking about is already paid by YOU in advance (am not sure if many of you are aware of that). An amount of approx USD 500 is collected well in advance (at the time your Petition is filed) as a Fraud Detection and Prevention Fee to the Department of Homeland Security (DHS) which is later utilized for this process.

                             If USCIS is satisfied with the Employers explanation, and if they react to the communication promptly with right information, they will Approve your Visa right away and will intimate your concerned Zonal Consulate or the Consulate Mentioned on your 797 requesting them to issue you a VISA which would in turn send you a Letter (hard copy) or an Email asking you to post your Passport via VFS for the Stamping. (This is the Outcome if they had the uncertainty regarding the Employers Side of the Story or Documents or other issues related to your Employer).

                             But, If the Reason for returning your case to USCIS is based on your Ineligibility for a H1B (Like any Mis-Representation of Facts, Not able to acquire Qualifying Bench Mark like Bachelors in Comp Science, Minimum Required Work Experience, If Educational Evaluation unsatisfactory, other issues related to Your Side of the Story or related only to your Facts) Then the chances of getting a Positive Response is thinner. ( Again not ruled Out )

                            Usually the Delayed / Refusal cases are categorized under these Categories:

                            221G : A simple BLUE form asking for Extra Supporting Documents required by them to take a decision on your Visa Issuance. A case Number is Marked on this Form for your further communication.
                            221G : A PINK form, which means your case is put forth for further Administrative Processing – You will be given a Reference ID for you to Track the Details of your Case online. This is mostly issued if they are not satisfied about your current employer or Work Experience related information in IND or any other issues related to your Qualification or Other issues beyond our Knowledge.
                            These PINK forms were given to one candidate coz his Name / Surname is very commonly used and hence they wanted to check for some intrinsic security checks before they could come to any decision with his case. and in another case which was purely a case of “Administrative Processing” But the reasons still remain disclosed, He was also given a Reference ID different from his Initial 221G ID, but this case still mysteriously remains Pending since 2006 July.

                            221G : A WHITE form is a complex category 221G - They return the Case to USCIS for further Verification. ( Reason of doubt not Known ) Most of the cases we can zero onto Employers Issues.
                            214B : Your Case is rejected presuming you to be a Potential Immigrant. – This is straight on the spot Denial of Visa ( I guess a Far better Scenario) mostly issued for H4.
                            NO CODE - NO FORM: This was my category where I was not given any Handout or any Code, but the Case been referred to USCIS for further Processing. I presume this case also comes under the 221G White Form Category.

                            So!!! Dear friends, I have thought of Summing up the Information that was shared till date into one reading and also by adding some Latest developments that were come across in the recent past. So that it shall make it lot easier for YOU to go through.

                            One Final Request for all of You, If we all can Clearly write down precisely their DATES of Visit and Further visits and the Dates when they Got their Intimation from Consulate and ALL other Communication Dates Between You and The Consulate. I am Sure It will Prove Very Useful to everyone of Us to assess an Approximate Time Frame depending on the Nature of their Individual Cases.

                              Mine is very bad experiance in delhi consulate.


                              i am working in bangalore for good MNC as a consultent. i had 2.2Y of exp with M.Tech background. and my US company is very small company...


                              i attended delhi consulate on 9/03/2007 for first round of interview one old person took the interview and he said i will send ur passport through mail. after 3 days i got 221(g) need for company docs like (tax,w2,emp list,organization chat and inhouse project details with notarization format) and they asked for personal interview in any businessday. Then my US company owner sent them in 10 days.

                              then i went for 2nd round in 22/03/2007.this time also interview was taken by same person who did on 1st round.


                              this time he asked lot of questions like.

                              Vo:US company is very small
                              Me: xxxxxxxxxxxx
                              VO:show me ur EXP letters?
                              Me: Showed all my exp letters

                              VO: show me UR Marks lists?
                              ME : Showed all

                              VO: Why u came to Delhi for interview? chennai is very near to bangalore but u people are think getting visa is very easy in delhi consulate......
                              Me: no sir and explained proper reason.

                              Vo: Took yellow form and tick at AAP Box and passthat form to me and told we will contact You after process complete.and i will talk to chennai consulate and i wll let you know u through mail or phone.
                              Me: please check now it self sir because my project time lines are already slipped of 2months.

                              VO: i have to check your documents once again and he arranged my all original docs in a properformat.

                              Me: how many day it will take sir?

                              Vo: may be in couple of weeks we will get back you.

                              Me : please try to check it now sir?

                              VO: no man i have to interview somany people today we will get back u ASAP.

                              ME: thank you sir.

                              1) Any one phased the same problem like hand over all original certificates?

                              2) After that any one got the visa? if got the visa how many days it took?

                              3) Any one came to your workplaces from consulate for cross verification?

                                Ther are couple of cases, do a little search in thie forum

                                2) After that any one got the visa? if got the visa how many days it took?
                                Yes there are lots of successful stories, but once the case is successful people are busy in flying to US they wont post theri stories, but even then there are some persons who have posted their stories in this forum..

                                Some time consulate guys do that. Its not for all the cases.

                                4) my exp and mark list all are genune things only the how much possibility to get visa?
                                Most of the 221g cases their marksheets and experience are very genuine, but even then lots of people getting rejected. Only VO knows why those genuine canditates got rejected.

                                Some cases yes, but most of the cases got stamping.

                                Usually VO will put a stamp. Iam not sure why he didn't do that.

                                Whatever might be scenarios differ from case to case. The only thing is be patient until you hear from consulate.......
