H1 Visa - 2007 Processing

Hi,

I am currently staying in USA on H4 Visa.My H4 Visa is valid uptill October 2007.Recently i filled for H1 Visa staying in USA.Now i have a query regarding my trip to India.I have to go to India in the mid of April or first week of May.
So is there any legal complications involved for my trip to India for a period of 1-2 months during my H1 Visa filling.
