H4 - H1, visit to india, pls suggest !!!

Hi All,

I am on a dependant status right now i.e., on a H4. I am applying for an H1 in this April's quota and I have plans of visiting India in July and coming back in september. Assuming my H1 approval or the I-797 will be in my hands by the end of may, following are my questions ..

1. My I-94/H4 visa expiration date is 30 - Sep 2007. Can I travel on this I-94 and come back before sep 30 ? How sooner would be better ?
2. Should I also carry my I-797 ?

Please suggest.

I am in the similar situation. My H4 validity is till October 08.
Assuming I get approval in June, can I travel in July and come back in august/early september without stamping? Any help appreicated...

H1 and H4 issues

---- Yes, you can. However, if you are applying for H1 and should it be approved before your entry to US on H4, then you may have to go for a H1 Visa stamp in India and then enter US.

---- If you enter US on H4, your I-94 will be only for H4 and not H1. On returning to US you may have to go out of the country for getting the Visa stamp and then enter US, seek a SSN and join your assignment

2. Should I also carry my I-797 ?

---- If you are talking about I-797 for H4 then yes, you should carry that with you while travelling overseas
