  • USCIS approval notice sent for H1b

    Hi Guys,
Applied for H1b in April 2005.
Whilst I was in OPT after BS degree from New York.
Application was denied first time with a request for evidence.
Was resent with all attachments from the lawyer back to USCIS
In the meanwhile OPT got over.
I then began an MBA course.
On March 14th 2007 approval notice was recd by my employer from USCIS.
At this juncture I have a few questions........
How long can I stall with this application before I get my meeting dates.
This answer is important to me.
    2 months ,3 months 6 months.
How long is the approval valid.
I am in MBA and cannot miss any classes by going to India for the interview.
I am at present on F-1 status.
I pass out at the end of the year.
Can I do a transfer from F-1 to H1b in the USA....if possible , then how.....
I can thus save a lot of time .
Please do attend to this request.
I need for you to answer.
    Thanks.

    Is there a time window....for H1b interview

    Dear friends,
H1b application 2005 was sent back to employer for further evidence.
It was resent with all evidence in good order.
In March this year...2007 , nearly 2 years later employer received a letter approving for H1b letter.
I had applied through the employer whilst I was on OPT as undergrad.
Since the OPT term expired whilst I was with the employer I began MBA
and in the course right now with a finishing date of Dec 2007
I have requested employer to offer me the job again and he is contemplating on doing so. From the date of the receipt of the approval consent sent to me in April is there a time window which will allow me to stall for the 'approval letter' activation....and how much time does the USCIS give...or for how much time is it valid. Please do reply as I am worried about the situation.
Also do I have to go to India to transfer F1 to H1 or can the transfer be done in the USA itself as I am currtently in University doing MBA.
Awaiting all help in this .....situation.
God Bless all who reply to this email.

---- What do you mean by stall for the 'approval letter' activation? Do you want to take up your H1 B job after completion of MBA. In that case you have only speak to your employer and negotiate with him and only they can help you

Also do I have to go to India to transfer F1 to H1 or can the transfer be done in the USA itself as I am currtently in University doing MBA.

---- Ideally you do not have to go to India, but remember if you do not receive the I-94 you may have to go to a US Consulate overseas to seek a H1 Visa and reenter the US
