Hello,
I have a question regarding my H1-B transfer. I work for company 'A' and have a valid VISA with them till July-2008. My wife's H4 is also valid till that period. I recently got an offer with company 'B' and they are filing my H1-B transfer this week. I am starting with that company in the first week of May as soon as they file my H1-B transfer. My wife has already planned an India trip in May for 2 months. Is she going to have any problem at port of entry when she returns back in July as I am working for a new employer? I heard that she can return back without any problem since my new H1-B transfer may not get approved within 3 months but what happens if I get that approved? Does she need to get stamped in India in that case? Please clarify.
