H1- Transfer

Hello All,

If a person is laid off from work while on H1-B and the company gives a package of 2 months pay that means pay stubs will be generated, How much time does he or she have to transfer H1 to another company. Also if he or she wants to invite her parents for visit what is the best way to do it? Any information on this will be greatly appreciated.

Normally, a person has a grace period of around 10 days to NOT lose their status. Strictly speaking, it should be done asap < 10 days. And as far as the package of 2 months pay does not necessarily mean that paystubs are generated for two months. It is only compensation being given to you for immediate lay off without notice (A company is NOT obliged to do so. It is only a good-samaritan gesture which old-fashioned companies still follow). H1 transfer must be immediate as mentioned above. If you want to invite your parents, you VISA must be active atleast till the period the visitors-sponsored by you are going to stay.
