H4-H1 got I-797B No I-94

  • H4-H1 got I-797B No I-94

    Hi,

    I am on H4 visa valid till Oct 1st 2007. I applied for H1B visa and approved.

    I recieved a copy of I-797B but No I-94 is attached in the bottom right corner of this document. To work on H1 visa, do i have to get H1b stamped then return to US with new i-94?

    If i don't travel to outside USA, are there any ways to continue working on h1b without stamping. Is there any way i can apply for i-94.

    Hi sivani,
    Are you in USA when you got your I-797 or you went out of country when your I-797B was in process. As you should have I-94 attached to I-797 unless you went out of USA when you H1-B was in process.

      It all depends on how the H1B petition was filed.

      If it was filed as "adjustment of status", then you would have an I94 attached. If not, no I94 - and will need to apply for the H1B visa stamp *before* starting the job.
