    Hi members,

    I am on H1-B and my H1 and I-94 are valid till Aug'09. but my visa in passport is going to expire by sep'07. I am working for one of the largest bank in USA in Information Technology.

    1. If I go for stamping before my visa expires, incase there is problem to get new visa in passport, Can I return into USA with valid visa(which expires may be in 1 month or few days)? or Do the visa officer cancel my existing visa even he rejects for renewal?

    2. How long I can stay in USA even my visa in passport expires having valid H1-B and I-94? If I go for stamping after 1 year of visa expiration, Will be there any problem to get it renewed?

    Please help me in this situation. I appreciate any help from members.

    ---- Mostly, the existing Visa on your Passport will be cancelled before a new Visa is issued/affixed/stamped on your Passport. You cannot return to US once this is done. If they want to further conduct any administrative processing, they will let you know and you have abide by their verdict

    2. How long I can stay in USA even my visa in passport expires having valid H1-B and I-94? If I go for stamping after 1 year of visa expiration, Will be there any problem to get it renewed?

    ---- You can continue your stay in the US as long as the I-797 and I-94 are valid and unexpired, irrespective of whether the Visa on your Passport and the Passport expire or not. Going for a Visa interview has nothing to do with the length of the exppiry of the previous Visa
