Visa Related problems

I have 2 doubts regarding my Visa.

1. Currently I am on L1 visa and so could i change my visa from L1 to H1B.
Is it so then what is the procedure for this. Currently i am working
for some company and so can i change my job from this company to another company and same time apply H1B individually and not through some company

2. My wife is on L2 and till now she did not get a job here. So, can
she apply individually for H1 visa without any company sponsoring her. If
it is so, what is the procedure for that and when she needs to apply.

1. You can change to H1B. But you will be subject to H1 cap and cap for
next year is already filled.

2. No. An employer must spnsor H1.

Thanks for the mail. According to your mail you said that I can apply for H1 cap (I am on L1) individually and it need not be through some company. But my doubt is you said that the cap for next year is already filled. Is there any other alternative for me to apply for H1B for 2008 or No.

And pl. tell me when I should start applying for H1B for 2009. I think I
should start somewhere around April 2008. Tell me the procedure and what all documents needed by me for this and where can I get them so that I will be ready by april2008.

Also are there any consultants or can I approach immihelp.com to process
my H1B for 2009.

1. You have to file for H1 in April 2008 to start working on Oct 1, 2008.
