    Hi,

    My consulting company has not paid me for the last 3 months. He claims that he has not received payment from the client and has not paid me as a result. In meantime, I think the client side has already paid him and that he has just not paid me.

    What can I do about this? CAn I complaint while am still with this employer? Will I be able to transfer to a different employer without a paycheck from this guy? Please help me

    It is a big fat lie. He has to pay you regardless. I used to get my paychecks late but he has to give your pay. Report him to Depart of labor and "Better business bureau". You can always leave the job provided you have a secured job waiting.And no harm..you can be upfront and honest and explain to your new employer how this clown has treated you. Employers will understand.

      1. Get the confomation from the client that they have paid your consultant or the layers above your consultant. Sometimes it is happening that the payment between the layers is a big time lag problem. Usually client pay's promptly.
      2. Post the consultants name so that others are aware that they should not join these bull&*^% guys
      3. Tell to the client that consultant is not paying you, this should have some result.
      4. Complain to the DOL.

      I don't think you can transfer without 2-3 paystubs

        this may be discouraging but when i was working for a fool, he used to giv me paychecks 15 days late and I informed the client about it.The client didnt even bother, he said "ba ba but we give it in anytime", this is how they reacted.the clients are happy as long as we work like a dog even at the expense of us getting paid late.

          I think, not all the clients are the same. You can give it a shot, nothing to loose.

          It is also a good idea to check back with each layer you have in between yourself and the client. If the immediate layer next to your employer also confirms that they have paid, that means your employer is playing game.

          In that case, you are sure you are not going to go with them for a long time. My first suggestion is - find another employer (may be a consulting firm) and convince them that they are ready to hire you if you are out of your current employment.
          2nd thing to do is talk to your employer in a polite but still firmly and tell them that if needed, you will go to "better business bureau" and DOL.

          Talk to your lawyer, if 2-3 pay stubs is a MUST to change employment in this kind of situations?
