  • H1-B Transfer....very very urgent

    Dear All,

I have a H1b from company A and is valid till Oct'07. I worked for Company A for one year and resigned in India. I filed for transfer thro' company B (in USA) and also got the approval from USCIS in this month.

Presently I am in India. My question is, can I go to US with Company A visa stamp before Oct'07? I will take all the papers related to company B.

    Pls reply at the earliest.....

    Regards,
    Victory.

Why don't you just go to the consulate with your new approval and get your visa restamped? I think, that is the most easy and most hasselfree option for you.
    Thanks,

---- Yes, you can travel to US with the current Visa stamped on your Passport. At the POE show your latest I-797 and get a I-94 till the validity of your new H1. Next time when you leave US you need to go for Visa stamping and only then enter US

---- It does not matter how long your present Visa is valid. Even on the last day you can enter US

Thanks a lot for your reply Subramanya....But, my new sponsor (company B) is telling me to get stamped in the US consulate and then travel to the USA.
He says that he received a RFE sometime back saying that "person not in US and need to get stamped in consulate nearest to the location".

I think nuser also suggests the same....
