If a person who is already on H1 for past 3 years wants to work for one more different job, does he / she have to apply for a second H1B through the second company? Or can the second company put the person on payroll using the first H1B?

Second H1b and it will probably be a part time job if not full 40 hrs. That is how it will be applied for, but it will be cap exepmt as the person has been counted against cap
