H1 Transfer (Subramanya your valuable suggestions pls)

I came to US in July 2007 for company A on H1B valid until 2009. I will work with company A until Oct and I want to go to India and come back after one month due to family reasons.

1. Can I apply for H1B transfer to new employer B before leaving US and come back to USA in Nov with the new I797 of employer B.

2. Is there any risk if i come back on the current employer without informing the current employer and then apply for a transfer to a new employer.

Please suggest the safest process in my case so that i will go for that...your valuable suggestions will help me a lot..thanks in advance....

---- Once you apply for a H1 transfer and leave teh country you are considered to hae abondoned your transfer application and thus it will not be reviewed or taken up for further processing

---- If you want a quick reply apply for premium processing

---- Yes, you can do that
