H1 transfer or new one

I am currently working in India . I have a valid H1 visa from my employer
and have worked in US for 3 months last year . I am planning to resign
from the company since i am getting married and will be settling in US .my
employer will apply for h1 cancellation since i am resigning . when i come
to US on h4 and then find another job then will my h1 application be
subject to caps or can i get the remaining 4 yrs of my h1 with0ut caps ?

As long as you are continuously on H1, you can do H1 transfer. Otherwise, new H1, subject to cap.
