  • L2-H1 COS? SUbrahmanya plz suggest

    am on L2 with EAD n working for an American firm n recently got my H1 approved with a desi consultant.my employer is pressurising me to join under his payrolls from Oct 1st this year with out any COS else H1 can be revoked !!!

    am assigned to a proj which will windup in Nov/Dec this year n am planning to be on H1 from Dec.but the H1 consultant says he can revoke.

    my qns: is COS not required to change from L2 to H1 ?if so, who should intiate the process?

    even if am telling the real situation about my project till nov/dec he is not listening...what other best answer can i give in order to be on L2 till Dec?

    can he revoke my aprroved H1 petition?

    ---- Yes, it is possible to revoke the petition, but under many conditions s the employer will be subject to scrutiny. Alternately, you can seek employment with another suitable consultant as the present one is threatening. Do not fall to these threats. They are just a hoax. If you are really interested in joining them let them know your terms and conditions. Nothing will happen to you or the H1 and the worst thing can be to transfer to another consultant

      I do have a very similar situation. Thanks for your response on this.

      Regarding transfer of H1B (as indicated above in worst scene), is it possible to do so even before joining the new employer that applied for H1B? Mine went for COS even without taking my consent and is now threatening action from USCIS if I dont join him by Oct 1.
