L2 Ead - H1

My Wife came to US on Dec 6th 2006 on L2 Dependant Status.

She applied for EAD and got her EAD on Mar28

She started working on L2 EAD status to a company since June, 2007

Meanwhile she has applied for H1 and her petition got approved and is valid from October 1st.



We would like to know



1) If we want to move from L2-EAD to H1 do we need to apply for Change of Status (COS) ?

2) Our H1 Consultant is telling that we no need to fill any Application as such and we can start working on H1

3) If that is the case what happens to the L2 EAD status?

4) Though H1 is valid from October 1st, can she still work on L2 EAD status?

If the new petition came with a new I-94 then COS is already happened and she ceases to be L2 and will have to join using H1, to continue using L2-EAD she can leave the country and reeneter using her L2.
This is based on your earlier posts.

Now if the new petition did not come with new I-94 then H1 work cannot start without either filing COS or stamping abroad. She continues to be on L2 and can work using EAD.

Thanks for the quick response !!!!! really a gr8 response in little time...i need to check with my employer whether they have received new I-94 with the approved pettion.
