L2 TO H1 Visa-URGENT PLS HELP

Hi,

I am on a L2 visa and as our visa expired we have applied for an extension and also EAD. Both are yet to approve and we have some query.
Now meanwhile I have a company which is ready to sponsor H1B for me and provide training to avail me a job. Is this allowed transfer L2 to H1.
Incase my husband go back to India can I still work here.
I have no idea as to how to proceed, or whether or not to go for this co.
I believe with L2, I hav to go back to India if my husband go.
So I hv to apply for H1 , is this correct/legal?

New H1B can be applied in the next quota year ie from Apr 2008. In case you get your case approved with valid change of status which will be effective from Oct 1, 2008, you need not leave when your husband leaves. In other words, after Oct 1, 2008 you will be on H1 status and no longer dependent.

One more question

Hi, Thanks for the reply. But if my husband go back to India, can I still be here working, with L2 & EAD. Or L2 can not work in USA, unless L1 is here?
Please advice.

if i is for vacation then you workin is ok as the intent to stay on L1 is there. But if it is for good then your L2 is gone as well.
