Hi,
One of my friend has B1/B2 visa and has travelled to US 2-3 times earlier for official purpose through his company.
He has filed for H1 through another company and he visited the Consulate 2 weeks back for his H1 Visa.
He was issued a 221(g) asking for more documents from his new employer.
The new employer says he is unable to provide the documents and asked my friend to come to US on his B1 Visa. As he would be issued a I-94 on B1 Visa at port of entry, he should get a new I-94 for his H1 enabling him to get SSN and start work. The Employer says he would ensure that he would have a New I-94 issued and he can work at the earliest.
Can any one give an idea about if this would work out and what implications this would have in the future?
