  • Out of status?

I am on H1 since October 1, 2007. I am not getting pay stubs as I am not getting any contract. Am I out of status? I heard that I can stay till 180 days in out of status mode without getting into any trouble in the future. Is this true? When should I be ideally leaving USA? on March 28, 2008?

    no you are not

No you are not out of status...as long as you have all the valid documents(h1B and I-94) you are not out of status...you might have problems(may be/may not be) when you apply for GC

Technically, H1B will be valid only when you have payroll from your Company. However, when you apply for GC - USCIS will allow upto 180 days under section 245(k) of Immigration and Nationality Act.

You might consider requesting sick or vacation from your employer t stay in status.

      Not a legal advise.
