  • Urgent 6 year/ I-94 expired

    Hi could some one give me a quick response about my situations. My 6th year H1 is expired Aug 1st 2007 and I-94 expired. My lawyer forgot to file transfer to new company and filed on Aug 28th premium processing received an RFE for pay stub for August which I did not have. Now my attorney said that I-129 will get approved but I need to go for consular processing. I think in India. I also just found out by obtaining a copy of my filing that she had filed in a non-technical category with the new employer which is not the same as the old employer. My 1-140 denied with the old company sep1 2006 due to company tax returns and not ability to pay the salary offered. What are my chances? What should I do? Please reply immediately?

    ---- How did you join the new company without any transfer applied for and having taken place at least with a receipt

    ---- This category issue is beteween you and the lawyer. You have to fix it and address the same correctly

    ---- Your denial of I-140 with your old company has nothing to do with your H1 transfer. The documents required for the H1 transfer should be provided by you and as requested by USCIS

    What are my chances? What should I do? Please reply immediately?
