No need to travel Mexico or Canada for H1 stamping !!!

Hello Experts,

Please advise me.

1. I made application for H1 visa from India through company 'A' in March-07
2. I came to US on L1 visa for company 'B' in May-07
3. I got H1 visa papers (notice of action) in Aug-07
4. Since I applied from India, I didn't get COS and new I94 along with notice of action
5. I want to join company 'A' on H1 basis

Q1. Do I need to go to Mexico or Canada to get H1 stamping?

Q2. Somebody saying that I need not to go to Mexico/Cananda. As I am in US on L1 basis, I can simply apply for COS (Change of status) and start working on H1 basis.

Please let me know your views from your experience and knowledge.

you can apply for COS but you will have to wait for approval before work.

To start work asap you will have to get a stamp.

I dont see any contradiction, your question was that can you do COS to H1 from L1 the reply was yes. now you asked when can you start work on H1 I replied when COS is approved.

think of it this way till COS is approved your status is L1 and you are not authorized to work on H1. does this makes sense to you!!!
