H1B transfer without pay stubs

I have my H1b through a consulting comapny and have received I 797. Till now he's not able to find a suitable job for me. I was on H4 when applied. My question is whether I can transfer my H1b to another empoyer with out a paystub as I havent started working yet. Another question is what is my legal status now: H1b or H4.

If your approved H1 is come with I 94 at the bottom and your start date is Oct 1, 2007, then you are H1 status now.

If you do not get project and job, better transfer to H4 , whenever you get good job you can back to H1

Thanks for replying me. I have been offered a job from another company. My concern is can i transfer my visa without a paystub as I just got my SSN in last week of Oct.
