Inquiry-H1/H4 restamp

Hi,

Can I get my H1/H4 re-stamped at Tijuana, my current H1 has expired over a year now? During interview if asked " has the company applied for Green card" what should I say? My company has just applied for labor clearance.

My dilemma is, if I say yes to Green Card question,don't you think it's against the H1 policy that you are not suppose to show any intention to immigrate.

H1 is dual intent. Therefore, you can say that your company has applied for your green card. No problem.

Thanks for your quick response. Do you think I can get my H1 and H4 for my husband restamped in Mexico since H1/H4(issued in India) has expired over a year ago?

Yes, as long as both of you have been in legal status all the time.
