Applying H4 when transfer approval has not been reveived

Hi,

I have recently changed my employer,and applied for an H1 transfer.I got the receipt notice,but not yet received the approval.I now want to apply for H4 for my family.Can I do it at this time?If yes, the I do have following questions :

I need to get the H4 on the basis of previous company's H1 approval or new company's's H1 transfer receipt notice.
Can consulate create any issues for this matter?

Would appreciate if someone can answer these queries.

Hi Swastivishrut ,

Better to wait until u got your H1 approved. If consulate identifies that your or not working for your previous employer, and if your family went to H4 with your previous H1, there is a chance that they may create problem.

So it's safe to wait until you got your new H1 approved and then go for H4 Visa.
