  • H1b Visa Stamping DS156 Question

    Hi

    I tried to find answers to my questions in forum but did not find any.
    I am going to India for my H1B Visa Stamping with my H1 Approved till 2010 and my expired H1 Visa stamp.

    #1 My Passport is expiring one year before my H1 Approval is expiring.
    I read somewhere that the passport should be valid for atleast 6 months
    after your intent to stay in US.
    What is the way to overcome this problem ?

    37. Are Any of The Following Persons in The U.S., or Do They Have U.S. Legal Permanent Residence or U.S. Citizenship? *
    Mark YES or NO and indicate that person's status in the U.S. (i.e., U.S. legal permanent resident, U.S. citizen, visiting, studying, working, etc.).
    I have my wife and kid with me even on my visit even though they will not be applying for their stamping. What answer should i put in here ?

    Expiration date on passport must be at least 6-months later at the time your passport stamped for H1B visa.

    At this moment, get stamp on your current passport and later in US you can renew your passport from Indian consulate. Your visa on old passport will still be valid until visa expired.

    Question #37 on form DS-156 asking whether any of your family member is LPR or US citizen or not? So write ‘NO’ and mention their status in US (I think, they are on H4 visa).

      My daughter is a US citizen by birth and my wife was on a H4 now using her ead to work.
      Do i need to mention yes or no in this Question ?

        Check the box SON/ DAUGHTER as ‘yes’ and mention ‘US citizen’ for your child.
