I have a situation, inputs will be appreciated:
1. I am on H1B, and my current stamped H1B has expired in Sept 07. An extension for the same has been applied in August, which is still pending USCIS.
2. I have also applies for EAD/Advance Parole this week, still pending.
Question -
I have to travel out of country this weekend, and will be returning late January/early February 08.
- Can I travel on a pending H1B petition - how will this affect (if any) my pending H1B petition? Can I use the approved H1B to re-enter (assuming it gets approved and I get the stamping on the passport?
- Can I use my EAD/AP to return back to US (assuming it gets approved before my return date)? How does my travelling affects (if any) to my pending EAD/AP petition?
