I am working as a consultant with Company A and my H1 is held with Company B. Now Company A wants to hire me as a permanent employee. But my 6 years would be completed in Sep 2005. By the time Company A hires me as a permanent employee it would be around Sep or Oct 2004. In which case there will be less than 1 year before my 6 yrs of H1 term is completed.
I would like to know if I file for Labour Certification in Oct 2004, can I still get the H1 extension in Sep 2005. What exactly are the rules pertaining to this?
Any help is highly appreciated.
