    I am in a condition where, I was on an L1 from mar-07 to Nov-07 with an employer. I changed from L1-H1 in Nov (apparently with some bad blood with my L1 employer). Now, he is refusing to part with my W2 forms. I have my reasons for not going back to him for the W2-s.

    Question is:

    * is it a mandate that the W2 is to be present at the time of filing taxes or is there an alternative to the same.
    * I have the W2 from the current employer (H1) will that suffice.

    any suggestions in this regard would be deeply appreciated.

    W2 mandatory

    If you have earned wages from any employer, even if it were for less than a month, you need to show those wages to IRS in your tax returns and your employer HAS TO give you the W2. There is no exception.

    If your employer is not willing to give your W2 to you, get your salary slip and call up the IRS. IRS will make your employer give you the W2 you require for your tax filing.

    In worst scenario, you can still file your taxes using your salary slip and ask your CPA (not just an accountant, a Certified Public Accountant only) to present the case properly.

    You should not have to worry if you're not doing anything wrong.

    PS: You need ALL THE W2 forms from all your employers for the fiscal year.
