  • Query on Visa Transfer - Urgent Help required

    Hi All,

    I am working with Company A which is India based leading IT Service provider. I am working in USA holding a valid H1 till 2010 from this Company A.

    There are some queries that will help solving the critical situation I am in to

    1. If I resign company A before initiating my transfer. How much time it takes by company A to revoke/cancel my H1. Can i continue staying here in USA and then find some company which can transfer my H1.

    2.In case of transfering visa does it make any difference in Transfer Process and Filing transfer if a) I stay back in USA while transfer process and b) If I have to go back to India and resign and come back with new H1 stamping.

    3. When my transfer process is initiated, Is it possible that I go back to India and resign and come back again on same h1 for company A whom I resign. My point is it may take some time when company A can cancel/revoke visa before which if I can enter USA again.

    4. If i initiate transfer here in USA and then return to India and resign my employer, Is it mandatory to go for Visa Stamping again.

    5. Usually how long does it takes to get the Transfer reciept after filing transfer and how long it takes for getting it approved in normal filing and premium filing.

    Kindly response to any question if you have idea on it. please let me know if the questions are not clear.

    It's highly urgent as in a week time I have to take decision look for company and initiate transfer.

    The minute you resign with out an H1b or any other non-immigration visa back up you are out of status, your company no need to cancel your visa for that reason.

    Before arguing with too many "if", try to find a job and get your H1 transfered.
    Once yo get H1 reciept you can join your new employer. If you apply through premium with in 21 days you get your H1 approvals.

      Thanks Great Guru for your response and suggestion.

      The reason for putting too many 'if' togather was that my current employer's policy is forcing me to resign only after going back to India. And I have already initiated the talk with them so by Jan end I may have to return unless I stay against their policy.

      I have discussion going on with couple of employer and consultant. All these questions were raised just to evaluate all the possibilities so that I can response and negotiate with them properly

      It will kind if you can highlight more to any of the questions.
