My fiancee is on OPT now which is valid until Dec 2008 and she is planning to visit India in Feb and stay there until May, a total of roughly 3 months. Her employer will apply for her H1B on April 1st, 2008.
We are getting married in April 3rd week and at this point I'm not sure on what visa/status shall my wife re-enter US in May. I'm on H1, so I can get H4 for her after April 3rd week. But is this a good option considering that her H1B application could have gone thru' by that time. How about re-entering on OPT itself ? I have heard that it's not completely risk free. What's the best option in these circumstances - H4 or OPT - considering her pending H1 visa application ? Please advise.
