I have a question for a friend of mine who is getting his H1B transferred
from company A to company B. He is still an employee of company A and decides
to do so till his H1 is actually transferred. So, having given this
background, I have 2 questions –
a)        If his H1B transfer petition is denied for any reason then in that
scenario can he continue working with company A without them ever knowing
that he applied for H1B transfer?
b)        If his H1B gets transferred and for any reason he decides to not to
join company B and continue with company A only then in that scenario can he
continue working with company A without them ever knowing that he applied for
H1B transfer?
As my friend is still an employee of company A, in both the above scenarios,
he won’t need to fill any forms to continue to be with company A, is this is
right statement?
