H1-B Transfer Question - Please help!

I am on H1-B status since 3 years and my employment with my current employer is being terminated in the 1st week of March.

If I get employment opportunity with another company after my termination date, will I be counted under the new cap or is it a simple H1-B transfer?

I read somewhere that as long as I don't leave the US for a year, I have six years from the expiry of my prior H1 to apply for an H1, regardless of the cap. Is this true?
