Situation: My H1B 6yr period expires on 25th Jan 2004. The time I have spent abroad after first entry to USA on H1B is 7 weeks. My labor application has been approved within less than 365 days after filing. Will be filing for I-140, I-485, EAD and Advanced Parole shortly.
My question is, Can I get a 7th year extension based on my labor approval even if 365 days have not elapsed since the day it was filed?? Or will i be eligible only for 7 week extension (time spent abroad during the 6 year period).
What are the other options on continuing to stay and work in the US before i get my EAD and AP approved.
Any information in this regard will be greatly appreciated.
