Do I need H4 approval notice to get my H4 stamping in India

I am stating my case aagin as a new thread after editing it.

I came to USA on L2(my husband was on L1 then) in 2003 which expired in 2004 Feb.In the meanwhile,my husband's employer got us H1 and H4 respectively.

I was on H4(no stamping on the passport,though) from Feb 2004 to June 2007.Now my husband moved to a new firm and in Oct 2007 he got his H1 approval notice but my H4 case is still pending.All I've got is the receipt notice.

We need to travel to India in Feb 2008.Can we go to the Chennai Consulate for my H4 stamping (pls remember I 've never got H4 stamped on my passport.It just shows an expired L2) with my current H4 receipt and my husband's H1 approval?My husband has no issues,as he has all the required docs for his H1 stamping.

Will there be any complications?

traveling while your case is pending with USCIS will abandone your case. If this is the case, you can apply for H4 at chennai consulate. If it is not urgent to travel, avoid it till you get your approval.

I dont know where this guy is coming from but yes while the H4 extension application will be abandoned as soon as you leave, you will be in no trouble.

You need to have spouse's H1 papers to get H4 stamped and the receipt for H4 extension to show that you filed timely and were in status the entire duration of stay. Even if you had the approval for H4 the only purpose for that would have been to prove that you were in status and you would have still needed to produce H1 docs anyways.
Do take the copies of prev H1 and the original H4 approval from 2004
