Can I file new H1 while last years blocked with 221g?

Hi All,

I was one of those fortunate to have got the lottery right during the April 2007 H1 visa spat!
I travelled to usa twice on B1 and working for 4 yrs with a big indian MNC. But filed my H1 through a US based company (a descent 5 million company). I attended for interview on Nov 20th @ chennai but got the 221g blue asking for more documents from employer.
Submitted the same on Jan7th. And when i sent a mail enquiring status I got a response that its under administrative processing.

So my question here is, can I apply for a new H1 application/pitition during this 2008 H1 quota which would open in April? My current employer (one of the top indian MNC) will offer this H1.
What should i do? Its important for me to go to USA, my fiancee is in US doing her MS! Can I try an L1 with my currunt employer?

---- Yes, you can. At the time of the Visa interview answer all the queries regarding your previous 221g (including withdrawal of that application)

What should i do? Its important for me to go to USA, my fiancee is in US doing her MS!

---- US Consulates are not worried about these matters when issuing a Visa (they can be polite in replying to you regarding this but no action on their part)

Can I try an L1 with my currunt employer?

---- Nothing prevents you. The type of Visa you want to apply remains your prerogative
