  • Need Suggestion regarding another H1B ?

    Dear Friends,

    I have appiled for H1B on 01-Apr-2007 through a Private consultant,

    which has been selected in lottery and for which iam yet to appear

    for Stamping - Personal Appearence(Since iam in need of certain

    documents from USCIS).

    Mean while my present employer has initiated the H1B Visa Process,

    requesting me to apply for 01-Apr-2008 Quota.

    I would like to know whether,is it safe to proceed with 01-Apr-2008

    Quota through my present employer,while 01-Apr-2007 H1B through private

    consultant is still under process ?

    Will that move affect the 01-Apr-2007 H1B through private consultant ?

    Pls sugget me what should i decide regarding this peculiar case ?

    My present employer has BEP status and is one among top 3 IT Companies in

    India.

    ---- If you already have an H1, the new H1 will be considered as a transfer and accordingly you will be approved. The Visa stamping from the old employer will have no bearing on the new H1

    ---- Even if you have not been to US and holding a H1, you will be counted against a 6 year cap. i.e. your H1 is valid till 2013 provided you renew it at the renewal cycle

    ---- If you want to hold two H1's you can do so providied you justify working for both the employers at the same time i.e. approximately 16 hours a day and meet your each employer's expectations

    My present employer has BEP status and is one among top 3 IT Companies in India.

    ---- Your employer can be the best in the world but it your H1 that matters

      I have decided to go ahead with my Old Apr-2007 approved H1B petition

      through the private consultant and dropped the plan,to file for the current

      Year's Quota during Apr-2008,through my present employer.

      Also i would like to know,if my company requests me to travel either on

      B1/L1 before June - (it seems that it requires a Max of 6 Months to

      get the document, I-824 from USCIS,and my consultant has filed ony in first

      week of december),is it still safe, such that it dosen't affect the H1B

      Process ?
