I came to USA to work for Company A on H1-B visa.
Recenty in May 2003, I took a vacation from Company A
and I joined Company B and they started H1-B visa
processing. How ever My H1-b has not yet approved from INS.
Now,I am getting paid by Company A for my 'Paid Time
Off (PTO)" and also receiving pay regularly from
Company B. I am only working physically at Company B
since May 2003. Here are my questions:
1. Is it legal for me at Company B without terminating
my H1B with Company A? What problems could I face with
the INS? Iam getting paychecks from both company A ( vacation/holiday)
and company B ( regular )
2. Am I in violation of any IRS/tax laws or any laws?
3. My H1-B visa from company A is valid untill 2005. I
am planning to go to India for wedding in next few
months. Assuming that I resign from company A and they
cancel the H1-B visa. Is my previous H1-B visa
stamping in the passport still valid for travel to and
from USA and also to get H4 visa for my spouse( my H1-B visa is still being processed )
4. If so , does doing premium processing of H1-B help?
