I went through your FAQ at your website. Your information is very useful to new applicants. Thanks for doing such a great service. I have one question about H-1 visa. Currently I am on F-1 OPT status . I am planning to apply for H-1 visa soon through my company.
1. Is is alright If i start this process in my company on March?
2. Suppose I have submitted the application in April and the processing is going on, what happens if I change companies midstream? Will it affect my processing? Can my earlier employer withdraw my application if i change companies [say in May]?
Here is the scenario:
I am currently employed at company A. Company A applies for my H-1. In May while my visa processing is ongoing, I get employed at Company B. If company A is angry can it damage my H-1 application, say by withdrawing it? Can Company B compensate for it by sending in an application as late as May [long after the cap is reached]. I plan to apply in the 20,000 quota for MS/PHD students.
