My employer thinks that I am about to change the company by transfering visa and he is withholding my pay checks as well as pay stubs(he is generating the ADP pay stubs). He stopped sending pay checks(with pay stub) from January except for the month of Feb. I got pay stub for the month of Feb 2003. I got three questions.
1) Can apply for visa transfer with one pay stub ?(I have one pay stub from 02/01/2003 to 03/01/2003
I lost hopes of getting my pay checks released. I still got a job from the current company and I regularly submit my timesheets.
2) What procedure I should follow for taking legal action against him ?
3) Also if He fires me from my job, how do I handle this situaion ?
I am on a H1B.
