Change of Visa status from L1/L2 - H1

Hi,
I did apply for H1 in 2004 and my petition was approved and it was valid from 11/15/2004 – 12/31/2006 . But I never went for H1 stamping and never worked on that visa.

I came to US in November 2005 on L1 visa and currently i am in US. Is it possible for extending my old H1 petition. If yes, could you please let me know the procdure.

Don't think ...

... that's possible. You or technically your employer will possibly have to re-apply for your new H1B.

it will have to be a new H1 but will not be subject to cap, hence no need to wait for April 1 to file or Oct 1 to start working. But if you do that then the time available on H1 will be shortened
