H1 visa NOT subject to cap

I'm currently on a B visa. I have an employer who is offering me an H1 visa that is NOT subject to cap. can the employer apply anytime for this visa or does he have to apply for it in april as well?
i appreciate your help alot....

Anytime, but a COS from B to H is not recommended. Goto your home country and go through consular processing.
