H4 Kid Help Needed

I have got the H1 visa, later my wife got H4. I came to USA 1 year back, a month after I reached US I got serious health problem, forced to go back to India, and I check up health and came back to USA a month later. I didn’t have any work after I came to USA since my employer did not provide me any job and I was staying with my friend but not working because of bad health. I have daughter, she doesn’t has visa, now I am planning to take my family, my wife, has valid visa but not the kid, while I apply for kid do I have to show w2 forms or any tax info?,I don’t have w-2 forrms. Can I show any medical reasons to visa officer? Or what Can I do in this matter.

If you are in US and not working, you are out of status. I think your problem is bigger than getting H4 visa for child. How did you re-enter the US? If you have not been working since your return and did not have the approval paperwork for your new job, you cannot transfer your H1B.

The consulate will likely want you to supply proof of your employment to get the visa. You really need to have your situation worked out before you try for visa for your child. You also likely do not have the financial resources to support your wife and child in the US at this time if you are living with a friend and are still having health problems.

I think your situation is complicated enough that you need to consult with an immigration attorney who can look at your timeline, assess the problems that you might encounter, and recommend the best procedure to follow.
