My friend came here on H4. Applied for H1. H1 approved in Jan 2002, but the I-94 was missing. Applied for I-94 in Mar 2002. The case is pending in INS. In the meantime the H4 has expired on Jun 01 2002. Husband H1 is valid.
Is her status valid ?
What is the course of action to be taken in case INS refuses to issue I-94 ?
Can she go to india and come back on H1 or H4 if it is rejected ?
Her husbands passport does not have the H1 stamp of the current employer. Does his passport need to have current employers stamp for her H1/H4 stamping in India.
Any help is appreciated.
