  • H1B Transfer Process

    Hi,

    I am currently on H1b and planning to get it transfered to another company. Currently I am on a project that would be there for another month and a half. Assuming that I start H1b transfer immediately and it gets approved before my current project ends. Who would bill me for the last days of this project Company A who currently holds my H1b or Company B who would hold my new H1b at that point of time.

    Also can I put a condition on Company B that their billing would start only when I start the new project. I also have a new project in hand which will start immediately after the current project.

    2. Also what is the cost I am looking at for H1b transfer and can I shift this cost to the new company.

    Please advise.

    What does the contract say? The contract for your project may be exclusively with company A.

    Some fees must be paid by company, others may be paid by you.

    You may want to check with an attorney about the contract since you may transfer mid project.

      Once a H1b transfer is filed, you can join the new company anytime using AC21 portability for H1b. There is no mandatory rule that you have to join them immediately upon approval as well. To answer your question, in short, you can continue with your present employer as long as the project is on and switch to new employer after that gets done and move to a different project/client.

        Thanks for the suggestion. Even I have the preference to complete the current project with my initial company. This give me opportunity to serve my contract period which is 1 year and would complete by the time I finish the currently project. So if I can join the new company after honouring my 1 year commitment , will the previous company have any say in this transfer??. I would have completed my commitment by then and I am planning to give the resignation with 1 month notice which is a clause in my agreement when they sponsored me. Please suggest if there is any catch in this.

        PS : I have a couple of question on the new company as well which i will post in a separate theread.

          Your current employer has nothing to do with the trsnsfer and will not even find out unless you tell them. As long as you have always maintained proper status and the new company is good and you have a project, the transfer will not be an issue.
