    I have a J1 visa right now which is going to end in July. I have already received the waiver from my home country. My employer is willing to sponsor my H1 visa. What is the process my employer needs to follow? do they need to make a new job offer so they can then apply for the H1 or can they just petition the H1?

    As you say you already have the waiver, rest all is similar to regular H1b processing. Are you with a cap-exempt employer like a University or a hospital or a research institute affliated to one? If so, H1b can be filed any time. Better early as your J1 expires soon.

    If it is not cap-exempt, you might be already too late for this year as USCIS is accepting applications only until April 7th for H1b.
