  • H1 to H4 questions Urgent

    Dear Experts,
    I am filing for H4 from H1. In the whole of last year, I only was able to work for about 4 or 5 months. The rest I dont have any pay stubs. Even this year I was not able to work on H1. Now I have decided to file for H4. In the most recent taxes, my W2 shows income only for those 4 months. My husband's W2 is a regular W2, we filed 2007 taxes jointly. So I am afraid that if I include our latest tax returns in the H4 application, my case might face problems due to the low income on my W2. Can anyone please advice in this situation?

    On H1, the employer must pay you all the time, even on bench. Recent pay stubs are required to prove that you have been maintaining your status. Low income on the tax returns also raises red flags during GC etc. One must be in legal status to appy for a COS within the U.S.
