  • H4-H1 Stamping in Canada-Ottowa with a H1 transfer

    Hi All,

I have my visa appointment in Canada on April end and want to clear about my situation.

I came to US in November-2005 and applied for my H1-B(COS) in May-2006 and got approved in Jan31st-2007 due to some queries.

I started workng on May05th 2007 due to some delay in getting job and transferred my H-1B to a new company in Sep-07 and got approved on Jan-08. Right now I am working with my new employer and I am having all my pay checks from May-07 till date.I am having the same I-94 number with extensions on date from starting onwards.

My question is whether is it OK to go for stamping with my new petition (I797) with a H-4 stamp on my passport and I don't have any experience letter with my old employer(my first COS H1-B May-Sept 07).

I really appreciate any help on my situation.

    Any one Please help me.

    Thanks in advance.

You need to have the I-797 approval notice for your second employer who/which is your current employer.

You don't need previous employer's experience letters. Paystubs/W2s are sufficient to prove you worked and were in status..

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
