AFTER SIX YEARS WITHOUT GC PROCESSING

HI THERE,

I could not apply for green card and my H1 is expiring soon, but my employer is willing to process h1 again, how i can do this, do i need to go back to my home country and apply again. can i do this .

If you have not started your GC process more than 1 year back, you can not stay in US more than 6 years. (Read about AC21 in H1 visa page on this website. ) You have to be out of country for 1 year and then again come back for 6 years.
